Dehradun: The case of illegal construction and tree felling in Pakharo of Corbett Tiger Reserve is now going beyond investigation and entering the judicial process. After ED, CBI is also preparing to file a chargesheet in the case. However, the agency is waiting for the permission of the government. Know about one such selected case of the country, which has been investigated not only by the top investigation agencies of the state but also by the top agencies of the country.
Let us tell you that the Enforcement Directorate i.e. ED has filed a chargesheet in the Corbett Tiger Reserve case. However, the chargesheet of the Central Bureau of Investigation i.e. CBI is still awaited in this case. In this case, CBI has sought permission to prosecute the officials involved in the case, but permission has not been received on it till now.
This is the rule related to permission for prosecution: Although CBI is still waiting for permission to prosecute the officials, but there is also a special rule related to it. Under which, if permission is not received, permission is automatically considered after a time limit.
Under this, the government has to take a decision on this within 4 months i.e. 120 days. In the month of April, the CBI had sought permission for this. In this regard, the government has time till the end of August to give permission for prosecution. If no decision is taken on this by August, then the CBI will automatically start further action on this. When ETV Bharat spoke to the departmental minister Subodh Uniyal on this matter, he gave information about the action. He said that a decision will be taken in the matter related to permission. This is a legal process and action is being taken as per the rules. It is expected that a decision related to permission will be taken soon. Earlier, ED has filed its charge sheet in this case. ED has filed a charge sheet in the Special PMLA i.e. Prevention of Money Laundering Act (PMLA) Court against two former DFOs i.e. Divisional Forest Officers (DFO) and two rangers on the charge of money laundering.
In this, retired DFO Kishan Chand, Akhilesh Tiwari, former ranger Brij Bihari Sharma and Mathura Singh have been made accused by ED. In this case, ED i.e. Enforcement Directorate has attached property worth Rs 1.75 crore. This property belonged to Kishan Chand and Brij Bihari Sharma.
Not only the state but the country’s big agencies are investigating the case: This case of Uttarakhand is the only such case in the country, in which not only the state’s biggest investigating agencies have investigated. Rather, the country’s biggest investigating agencies are also taking action on it.
Corbett Tiger Reserve Uttarakhand’s vigilance has already investigated the illegal construction and illegal tree felling case in Pakharo. Similarly, it has also been investigated under the chairmanship of DG of the Forest Ministry of the Government of India. From the police to the forest department officials, different investigations have also been done on the case. Whereas, the biggest investigation agencies of the national level, CBI and ED have also completed their investigation on it.
After ED, CBI can also file a chargesheet on it soon, but at present, CBI is waiting for prosecution permission from the government for a long time and due to which CBI is not able to file a chargesheet on it at present. In this way, as soon as CBI gets the permission for prosecution, like ED, CBI will also file a chargesheet in the case.
